Terms of use

1. Agreement

These Terms govern your use of alexfolzi.com and the Alex Folzi app, including the desktop web app and the iOS app when it is available (together, the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Service.

2. Who we are

This website and the Alex Folzi service are operated by IT Custom Solution LLC. The Alex Folzi name and associated trademarks are used by IT Custom Solution LLC under license.

3. What this site is

This public website describes the available desktop web app and the boundaries of features that remain gated. Statements about iOS release, supported devices, future coverage, pricing, and external validation describe current plans only and may change. Nothing on this site promises iOS launch timing or unsupported capability. The desktop web app is available now. The iOS app is not yet available on the App Store.

4. Intellectual property

Except for materials identified as belonging to third parties, this website's content is owned by IT Custom Solution LLC or used with permission; the Alex Folzi name and associated marks are used under license. You may view and link to the site freely. You may not scrape it at scale, republish its content commercially, or use the Alex Folzi name in a way that suggests affiliation without written permission.

5. Acceptable use

Do not attempt to breach the site's security, probe or overload its infrastructure, submit false information, or use the site for anything unlawful. We may block access that violates these terms.

6. Honesty about accuracy

Measurements from a scan are uncalibrated estimates. Each is shown with its uncertainty, and the Service does not recommend a size from them. Generated images and videos are labelled as generated; they are not photographs and are not evidence of how a garment will fit. Garment details suggested from a photo are suggestions for you to confirm. Do not rely on the Service for medical, health or safety decisions. The accuracy page is part of these Terms by reference.

7. No warranties; limitation of liability

The Service is provided as is. To the maximum extent permitted by law, IT Custom Solution LLC disclaims implied warranties and is not liable for indirect, incidental, or consequential damages arising from use of the Service. Nothing in these terms limits liability that cannot lawfully be limited.

8. Governing law

These Terms are governed by the laws of the State of New York, United States, except to the extent the law of your state applies and cannot lawfully be waived. Nothing in these Terms limits rights or remedies that cannot be waived under applicable law.

9. Changes

We may revise these Terms prospectively; revised Terms will identify their effective date. Changes do not apply retroactively, and we will seek additional consent where applicable law requires it.

10. Your account

• You must be 18 or older to create an account. We ask for your date of birth to confirm this and do not store the date.
• Keep your sign-in secure and tell us at [email protected] if you think someone else has used your account.
• You are responsible for the content you add, including photos. Only upload photos of yourself, or of garments you have the right to photograph. Do not upload photos of other people without their permission, and never of anyone under 18.
• You keep ownership of the photos and information you add. You give us permission to store and process them only to provide the Service to you, as described in the Privacy Policy. Optional uses, such as model training or brand sharing, happen only if you turn them on.
• The community guidelines apply to any sharing feature.

11. Subscriptions purchased through the App Store

This section applies if you buy an Alex Folzi subscription in the iOS app.

• Payment. Payment is charged to your Apple Account when you confirm the purchase. The price and billing period are shown in the App Store before you confirm.
• Auto-renewal. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the current period ends.
• Cancelling. You can manage or cancel your subscription at any time in your Apple Account subscription settings. Cancelling stops future renewals; you keep access until the end of the period you have paid for. Deleting your Alex Folzi account does not cancel an App Store subscription.
• Refunds. Refunds for App Store purchases are handled by Apple under Apple's policies. Request one through Apple.
• Free trials or offers. If an offer includes a free trial, any unused part of the trial ends when you buy a subscription.
• Price changes. If the price changes, Apple will notify you as its rules require, and the new price applies from your next renewal.
• What we receive. We receive the subscription status from Apple, not your payment details.

12. Apple's terms for the iOS app

The iOS app is licensed to you under Apple's standard Licensed Application End User License Agreement, together with these Terms. Where these Terms and Apple's standard EULA conflict for the iOS app, Apple's standard EULA applies to the extent required. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.

13. Ending your use

• You can stop using the Service and delete your account at any time from the account privacy controls in the app, or by following alexfolzi.com/delete-account.
• We may suspend or close an account that breaks these Terms, including the age requirement, or to protect the Service or other people. Where reasonable we will tell you why.
• After deletion, your data is handled as described in the Privacy Policy, including the limited records we must keep.
